These Terms and Conditions (“Terms”) govern your use of our website giftbento.com.au (the “Site”) and the purchase of any gift hampers or related products (the “Products”) through the Site. By using the Site or purchasing Products, you agree to these Terms.

1. Use of the Website

  • You must be at least 18 years old to use this Site and place an order.
  • You agree to use the Site for lawful purposes only and in accordance with these Terms.
  • You are responsible for ensuring that any information you provide is accurate, complete, and up to date.

2. Product Orders

  • All orders are subject to acceptance and availability.
  • We reserve the right to cancel or refuse any order at our sole discretion.
  • Prices are listed in Australian dollars (AUD) and are inclusive of GST unless otherwise stated.
  • We aim to keep product listings current, but availability may vary.

3. Payment

  • We accept payment via Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay and PayPal.
  • Payment must be made in full at the time of placing your order.
  • All transactions are processed securely. We do not store your payment information.

4. Delivery

  • We deliver within Australia.
  • Estimated delivery times are provided as a guide only and are not guaranteed.
  • You are responsible for providing accurate delivery information. We are not liable for delays or failed deliveries due to incorrect details.

5. Cancellations and Refunds

  • Orders can be cancelled within 2 hours of purchase if they have not yet been processed or dispatched.
  • Due to the perishable and customised nature of our hampers, we do not accept change-of-mind returns. Refunds or exchanges are only provided for damaged, defective, or incorrect items.
  • To request a refund or replacement, please contact us within 48 hours of delivery with photo evidence of the issue.

6. Substitutions

  • Occasionally, certain items may be unavailable due to supply issues or seasonality.
  • We reserve the right to substitute unavailable items with similar products of equal or greater value while maintaining the overall theme and quality of the hamper.

7. Allergen Disclaimer

  • Some hampers contain food and beverage items with common allergens such as nuts, gluten, dairy, and soy.
  • We do not guarantee that our products are allergen-free. Please check all labels before consumption and contact us if you have specific concerns.

8. Sale of Alcohol (Applicable in Australia)

  • Some of our hampers may contain alcohol. Under Australian law, gift hampers may include up to 2 litres of alcohol per package.
  • By purchasing a hamper that includes alcohol, you confirm that you are 18 years of age or older, which is the legal drinking age in Australia.
  • Alcohol will only be delivered to a person aged 18 or over. Identification may be required at delivery.
  • If an eligible recipient is not present at the delivery address, the hamper may be returned or redelivered at your expense.
  • We reserve the right to refuse or cancel any order involving alcohol if we believe the sale would breach liquor laws or our terms.

9. Intellectual Property

  • All content on the Site - including logos, images, product names, text, and graphics - is owned by Gift Bento or its licensors and is protected under Australian copyright and intellectual property laws.
  • You may not use, reproduce, or distribute our content without express written permission.

10. Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential losses arising out of your use of our Site or Products.
  • Our total liability for any claim shall not exceed the amount paid for the specific order giving rise to the claim.

  • Your personal information is collected and used in accordance with our Privacy Policy.
  • We are committed to protecting your privacy and complying with the Australian Privacy Act 1988 (Cth).

12. Governing Law

  • These Terms are governed by the laws of Western Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts in that region.
